All of the terms and conditions contained herein (hereinafter referred to as “Terms”) bind both Tel-Systems and the Subscriber for a period of 3 years with auto annual renewal and are subject to change from time to time at the sole discretion of Tel-Systems , without any prior notice to the Subscriber. Please logon to our website for updates.

1.0 Emergency Services- 9-1-1 Dialing through VoIP (Voice Over IP) services
911 emergency service over a VoIP phone (Broadband Internet) has certain limitations compared to Enhanced 911 services available on most traditional phones. It is important that you understand and agree to the conditions and limitations regarding 911 service outlined in this service agreement update.
ThinkTel’s 911 service is available upon Service activation. Applicable 911 fees are charged as of the service activation date. The 911 service provided by ThinkTel differs in a number of important ways from traditional 911 or E911 dialing available with most traditional telephone services – and has specific limitations relative to Enhanced 911 (E911).
E911 vs. Basic 911 Service
When placing a call to emergency services with E911 or Enhanced 911 the user’s telephone number and location are automatically transmitted to the operator during the call.
With Basic 911 (B911) the user’s telephone number and location are not automatically transmitted to the operator. The operator at the answering location verbally obtains the pertinent information that identifies the caller’s need and physical location. The operator then determines the appropriate agency and transfers the caller.
Tel-Systems provides a basic 911 type service.
911 Service Description
When the user dials 911 the user’s call is routed from the ThinkTel network to our emergency services operator. The user will need to confirm with the operator that they are still located at the address the Customer has registered with ThinkTel. If the user calls from a location other than the address registered with ThinkTel, the user will need to provide our operator with a current address or location. The operator will then determine the appropriate emergency agency and transfer the user’s call accordingly. There may be an additional delay to transfer the user’s emergency service call to areas not served by traditional 911.
When the user dials 911, they are not to hang up unless told to do so by our operator or the emergency service attendant. If the call is disconnected prematurely the user will need to call back to re-establish a connection with the emergency services. The Customer must provide ThinkTel with the service address for each activated and/or ported DID and/or charge number as applicable and ensure each location information is kept current at all times. Only DIDs and/or charge numbers that are provisioned with ThinkTel and have applicable fees paid may be used as the Calling Party ID for 911 calls. The use of any other DID or charge number constitutes a violation of this Agreement and a public safety hazard. In the event the user is unable to speak during a 911 call our operator will automatically dispatch emergency services to the address registered on file. If the user dials 911 when they are outside of Canada or the United States our emergency services operator will advise them to hang up and find a local phone line and dial the appropriate emergency services (it may not be 911).
1.03 Service Outages
9-1-1 Dialing service will not function in the event of a power or broadband outage or if your broadband, ISP or VoIP service is suspended or terminated. Following a power failure or disruption, you may need to reset or reconfigure your Telephone Adapter prior to utilizing the service, including 9-1-1 Dialing.
1.04 Re-Registration Required if You Change Your Number or Add or Port New Numbers
You must update and verify online by email your location of use for each changed, newly added or newly ported number in order for 9-1-1 Dialing to function correctly. firstname.lastname@example.org
1.05 Network Congestion; Reduced Speed for Routing or Answering 9-1-1 Dialing Calls
There may be a greater possibility of network congestion and/or reduced speed in the routing of a 9-1-1 call made utilizing the Service as compared to traditional 9-1-1- Dialing over traditional public telephone networks.
1.07 Disclaimer of Liability and Indemnification
We do not have any control over whether, or the manner in which, calls using our 9-1-1 Dialing service are answered or addressed by any local emergency response center. We disclaim all responsibility for the conduct of local emergency response centers and the national emergency calling center. We rely on third parties to assist us in routing 9-1-1 calls to local emergency response centers and to a national emergency calling center. We disclaim any and all liability or responsibility in the event such third party data used to route calls is incorrect or yields an erroneous result. Neither Tel-Systems nor its officers or employees may be held liable for any claim, damage, or loss, and you hereby waive any and all such claims or causes of action, arising from or relating to our 9-1-1 Dialing service unless such claims or causes of action arose from our gross negligence, recklessness or willful misconduct. You shall defend, indemnify, and hold harmless Tel-Systems , its officers, directors, employees, affiliates and agents and any other service provider who furnishes services to you in connection the Service, from any and all claims, losses, damages, fines, penalties, costs and expenses (including, without limitation, legal fees and expenses) by, or on behalf of, you or any third party relating to the absence, failure or outage of the Service, including 9-1-1 Dialing, incorrectly routed 9-1-1 Dialing calls, and/or the inability of any user of the Service to be able to use 9-1-1 Dialing or access emergency service personnel.
1.08 Alternate 9-1-1 Arrangements
If you are not comfortable with the limitations of the 9-1-1 Dialing service, you should consider having an alternate means of accessing traditional 9-1-1 or E9-1-1 Dialing services or terminating the Service.

2.04 Credit and Security Deposits
Tel-Systems reserves the right to examine the Subscriber’s credit record before activating the Services. Tel-Systems will determine, at its discretion, how the Subscriber’s deposit or other security will be allocated to satisfy outstanding amounts owed by the Subscriber to Tel-Systems . By subscribing to the Services, the Subscriber authorizes Tel-Systems to investigate the Subscriber’s credit worthiness, exchange credit information with credit reporting agencies on an ongoing basis and agrees from time to time, to provide appropriate authorizations and financial information as Tel-Systems may reasonably request for this purpose. Switching takes a few business days (Migration) after you have provided Tel-Systems with consent. Tel-Systems shall not be held liable for any long distance charges incurred by you before the migration is complete.
